The Reforms I expect in India – The next Generation (Telephone Revenue)
The value of a paisa - unfortunate coins of India from Rs.1 and below, made me to write this. A cent is considered as a valuable unit in USA and not only that, even still decimals of a cent are considered as of much value. The coins are minted in large quantities and it is increasing year by year in USA, to the best of my knowledge.
Long back I remember to have seen a Paisa – the 100th of a Rupee, and there were 2,5,10,20,25,50 paisa coins and this was perhaps when there was some value for all this. I do not think even these coins are minted now a days. Interestingly even beggars do not accept less than an Rs.2 coin and Rs.1 is not being considered as a valuable unit of measure and this is the practical position. This position is nothing new to any Indian. Knowing all this fully well, why the Government puts up some improper regulations in an irregular and impracticable manner, remains to be an unsolved question when all this needs a simple commonsense.
The purpose of my writing all this is simply linked to the tariff of a phone call in telephone booths throughout the country. I believe (I presume that the tariff is something like Rs.1.32ps) Rs.1.32 paisa or so is the minimum tariff for a phone call. I do not really understand as to why the Government keeps a fancy of maintaining an odd charge for such an important public need. I believe that at least a fifty lakhs calls are made in these public booths throughout the country on any day, on an average.
I started analyzing the subject. No booth owner accept Rs.1.32paise religiously, for the simple reason, neither he keeps such a change, nor the customer carries such odd change, nor such change is useful for both of them in any manner outside. Perhaps, if any one wishes to observe strict discipline and carry a change that suits a call, the booth owner unhesitatingly demands a minimum of Rs.2 and makes fun of our sincerity. Thus, a consumer is forced to pay Rs.2 the next immediately acceptable coin beyond Rs.1/ - and the difference of Rs.0.68ps or so, goes to the pocket of the Booth owner.
If the Government is a little wise in its tariff, say, if it charges Rs.2/ per call and make the tariff in round sums of a rupee, the amount which goes to the pocket of the booth owner straight goes into the revenue pooling of the Government and the consumer is nothing to lose additionally. Assuming for a while that the Government is getting at a rate of Rs.0.40ps per call from a consumer beyond what they are charging today, on an average, that would be Rs.20 lakhs of rupees a day and it is something like 72 crores of rupees revenue a year – may be something more if accurate statistics are available.
It is time for the Government to think of this wisely and it is advisable for the Government to implement such systems which are practicable and possible in real life. DESIRABLE NEW SYLLABUS FOR FUTURE GENERATIONS

As usual Government is making preparations for printing of school books for the forthcoming new academic year and there are arguments and counter arguments today in the news paper. I am observing a number of school going children and small kids driving motor cycles with a high speed enjoying the craze of the speed and thus resulting into accidents. I have also observed a number of children and aged too spitting on the road and using public places as toilets wherever they desire irrespective of the sanctity of the place and this is a common seen while law protecting force remain themselves in a state of silent audience. Probably this is in an irreparable state as is seen today. In most of the apartment complexes we find red patches on the walls particularly at lift points and wall corners. Perhaps nothing can be done to educate the grown at this stage, but surely something can be done over a period of time if we start dedicatedly educating the forthcoming generations from now on. This is nothing to do with the vote bank politics and the Government and the administration should feel happy about this, instead of letting the matters to go on their own leaving the image of the country to its fate.

Now my suggestion is only that a new syllabus to be introduced in all the text books for all classes particularly relating to traffic rules, road signals, driving methods, usage of the vehicles beyond sound and atmosphere pollution, optimum utilization of the fuel and its methods etc. This will help children to know the road rules and respecting the law besides helping the Nation to control pollution. It is a common seen on the road, when children use horns at an extreme level with all impatience even when the red signal is on at the cross roads.

Similarly let us educate children from the childhood stage itself to remain disciplined without spitting and using public places as toilets wherever they like and whenever they wish. This is the basic need of the Country. In all cities we find rotten smell in most of the public places. Red spit marks are of common visibility inside the four walls when a grand appearance is noticeable for the building outside.

Another area is throwing of waste material making the entire city as a dustbin. Waste material disposal should be a uniform lesson for all children so that the roads remain clean.

Lessons relating to these areas are to be incorporated in all the text books invariably and children should be taught as to how they should remain disciplined and how they should behave as a good citizen and this is perhaps the only solution for this ghostly disorder of life in the country.

It is surely a long rage plan but will help us to reform the future generation as good citizens over a period of time. Interestingly, our own people behave in a different fashion as disciplined persons elsewhere in other countries.

Can we do something in this direction?

Why can’t the pontiffs help building up uniformity?
Yesterday once again the news relating to the decision of celebrating Ugadi festival was on TV. Perhaps innumerable number of the TV audience might have enjoyed the conversations and counter arguments for fixing up a date for Ugadi. Years ago, I was with one of the Jagadgurus and suddenly a servant entered the room and in the local language asked the pontiff a question as to why a uniform date for Ganesh Chaturdhi could not be fixed much in advance. He further questioned the Jagadguru as to why the Jagadguru could not interfere in such a matters of dispute and settle the matter using his position. All that agony was, he purchased material for Pooja and there was a controversy with the date and the material will not remain fresh for the next day on which Pooja was to take place as per new controversy. I could dare putting a question though I had the same question in my mind.

Kanyakumari to Jammu, majority of Hindus accept and follow rituals and respect the Vedic system or Puranaas, which are the backbone for most of the rituals and Holy festivals. Incidentally oblations are offered in different fashions at each place and more so even within the same region. Authorized and unauthorized personnel perform all types of rituals leading to utter confusion and resulting into lack of faith in the systems. I really do not understand as to why the Jagadgurus do not appear on one dais and insist for a uniform calendar throughout India and Uniform procedure for all rituals – at least on region base wherever the necessity demands. They could have established a Common University for settling matters of dispute relating to Sanatana Dharma and Traditions, more so conducting examinations and granting qualifications for those who can perform rituals. This is a point beyond power politics and vote bank technique. And I sincerely believe that this is WHAT IS MINIMUM EXPECTED OF THEM IN THE CHANGING SITUATIONS.

I desired to create a Uniform platform for many Pontiffs who have innumerable number of followers at different places and it was my trust that all of them together can resolve many issues concerning Hindus and others too. But then, it was a futile exercise, when some one refuses to appear on the stage if some other person of other branch is invited and so on. Once again, my eyes were filled up with tears of joy when the Head of Sikh Religion HH Shri Vedantiji accepted my invitation and respected the ideology behind. I could not arrange for funds for the maintenance of the Pontiffs for that one day program when some of them demanded for it.

Are the Pontiffs been given position for their comforts or for their self elevation and is it not their fundamental duty to come forward to establish a peaceful society beyond controversy? – my mind goes round this unanswerable question and my heart gains weight and my eyes fills up with tears of sorrow as to why we fail to build up a Healthy atmosphere. And, more so why two pontiffs of different branches do not appear on a common platform to create a constructive approach. If they too have likes and dislikes, what is the other alternative and who else can guide all of us? Any possible solution in the near future? – Perhaps we may have to wait silently for the time.

And, now the matter relating to celebrating Ugadi on 19th or 20th is a burning point for discussion on the TV and people enjoy seeing the TV when arguments and counter arguments go on between pundits – known and unknown. This is where we are. If we fail in such small and trivial matters, how are we to face challenges and how can we build up a Casteless society and establish only one and only one HUMAN RELIGION? NEED OF THE HOUR FOR CONSTRUCTIVE NEWS IN MEDIA

Today I am forced to compose this page as an additional page for the book which is being written by me in the name of “The Reforms I expect in India – The Next Generation”. This is just because I saw a news items just now, in one of the popular local language papers of Hyderabad which has incidentally highlighted Aswamedhayaagam which is taking place some where in Jaipur in Rajastan. I really felt for sometime as to why the same local news paper could not high light the same activity “Sri Aswamedhayaagam” which took place just a few kilometers from the main office of the paper when I took all pains to perform the same in the month of December 2005 inviting great rishis. But then, my agony is that the MEDIA could not make even Local Hyderabadis to know better about the Yaagam in December 2005 and now an activity which is taking place somewhere in Jaipur is highlighted in the local language. I appreciate surely the publication of the news items today since constructive activities are much needed to be brought to the notice of the public than news concerning momentary pleasures and cheap incidents which has absolutely no relevance to constructive path of human life.

INTERESTING IT IS- But again, an activity of National Pride – honoring a scholar in the name of MAHAA KAVI KALIDAAS with Mahaa Kavi Kaalidaas Gnana Ratna Award, took place in Hyderabad when the Hon ‘ble Home Minister of the AP Government Shri K Jana Reddy presided over it on my invitation. This should have been a National Level Event at least after noticing the news when an idol of Mahaa Kavi Kaalidaas was installed in the Capital of China. I really shed tears on the day when I read the news of installation of an idol in China and felt sorry as to why we could not honor Great Poet of this land when neighboring country preferred doing the same.

I am a small man but within my limitation I requested the Hon’ble Home Minister and a group of persons unanimously selected Shri Pullela Sri Rama Chandrudu to receive this great honor. The award function took place on 8th December 2006 in Hyderabad. The entire expenses for the award or for the function were borne by me personally.

I had sent a fax to almost all news papers requesting for publication of the news as a news item so that there would be a good gathering in appreciation of the activity. Excepting one or two small news papers, media did not come forward to publish the news prior to or after the honor to make public know about the importance of the Award or Great Poet. I had a practical problem to convince the media about the importance of the event. A few attended who could be contacted by me personally, but then the public remained unaware of the program. And a Great Event was concluded with a meager attendance. Is the Media thought the resultant attendance fair and reasonable – I have to leave this question for the self analysis of the Media and Media People only. Had the Hon’ble Home Minister been not present, probably one or two small news papers which have published this event, might preferred to skip this news and this is what is going on – don’t we agree?.

I really do not understand as to why the MEDIA fail to give weightage to such events of National Importance. Is it on account that the program arranged by an Ardhrite? Or is it because it is arranged by an ORDINARY Citizen who has no political affiliation etc? Or is it for any other reason beyond description on this paper? A small incident would have been given more importance than information relating to a constructive activity of National Pride – where are we and where do we and the Media stands?

I have no other option than to leave the answers to the judgment of the readers. The fact remains – I shed tears and I am shedding tears as to why we fail to construct a Healthy Nation and a healthier Citizen who remains helpful in the Nation building activities.

ELECTORAL REFORMS
I am noticing quite a good number of enthusiasts for contesting in the elections in the recent times. I appreciate the public intention to keep themselves in the leadership positions. But then, I feel sorry and very bad to look at the shabby walls of public places and even private houses too covered by the handouts, stickers, wall posters and what not. To the extent of contesting in the elections if appreciated, what answers do we have for the ugly and indecent propaganda. What problem does the election commission have to restrict such campaigns and keep the public places clean and neat? It is beyond imagination for any one to assess the individual losses due to this, for the simple reason, soon after the election campaign the owners of the buildings struggle hard to remove the stickers and get their walls repainted and pathetic it is, another election campaign either for local bodies or for State bodies or for central bodies – what not, again starts.

The most important point in the election strategy is, yet, another interesting thing. In a recent election campaign, for just one single seat, there were 60 contestants. Assuming for a while that there are hundred voters in that constituency, 40 votes will be a deciding factor to elect a candidate. It is likely one candidate may get only 3 votes while the rest others get two or less. Invariably, the person who could get only 3 votes gets elected irrespective of the intentions of the majority of the voters.

Keeping these two points in view, I suggest the Election Commission to give clear guidelines to all those who desire to contest, that the candidates shall not under any circumstances cause or damage the public places or private properties either with their campaign stickers or wall posters etc and in the event of some contestant doing so, he shall be disqualified for the candidature.

The second is a sensitive point where most of the political parties need to be taken into confidence for implementation. The candidates who desire to fight the election should be preferably from the National Parties. In the event of anyone contesting the election as an independent, he should be able to mobilize from his supporters or meet the deposit amount on his own, the deposit amount being a huge sum where an individual fancy contestant can not bear on his own. In the event of loosing the election, such independent candidate should wait for a clear year to get back his deposit amount. This may help reducing a number of candidates contesting the election as a matter or fancy or for a division of votes on the basis of caste based politics.
Probably we may help quality based leaders from a selected small lot. The future leaders may at least acknowledge that “Cleanliness is next to Godliness”.

The reforms I expect in India – The next Generation The ways to curb black money
The purpose of my sending the articles through th is mailing system to all of you, is only that, at least one amongst you can seriously take these problems to heart and those who are close to the Government may try to get the suggestions implemented. The presentation is not meant for any reward or remuneration, nor for appreciation. I consider this as my duty as a proud citizen and I look forward for reforms keeping in view of the The Next Generation.
Black Money, that is unaccounted money and Corruption or corrupt practices, is interlinked. Unless there is a change in the attitude of the political parties, corruption cannot be controlled and as long as corruption is not controlled, growth of black money becomes inevitable. Then, within these parameters the best solution for this challenging problem should be planned out. Sometime ago, may be, twenty five years back when I was designing “Common Universally Acceptable Paper Currency” with a different ideology, the “Black Money” problem was also to my attention and then I drafted a note and sent it to the News Papers for publication. Interestingly there was response from different sectors including Planning Commission and nothing could presumably be the ultimate result. However, the subject relating to Universally Acceptable Paper Currency was taken by the University of Economic Sciences, Berlin and the result is the present EURO CURRENCY.
Back to the subject, on account of hard cash in the form of Black Money, not coming to the account, the Government is losing a lot of revenue and it is not in a position to deliver the goods expected of it. Due to falling short of resources, the deficit between revenue and expenditure, has become another problem every year resulting into additional taxes only on the legitimate tax payers while non-tax payers particularly money hoarders are indirectly gaining support. Added to this, money hoarders or holders of “Black Money” are controlling political parties, there upon diluting the values. The country is not gaining progress in the lines expected of it due to mixing up of all this. I believe,the next Generation is aiming highly on it with lot of demands and expectations, therefore a solution to this burning problem has become a must.
Accounting of a transaction will help the Government to find a solution to this ever growing problem. The business establishments are not accepting accounting of the transaction due to “complicated tax system”. There is a saying – “if you cannot convince, confuse”, perhaps this is being followed by the Government. The confusion that the Government has created this year by introducing new tax returns is really a mess and even the Accounts Experts and the Tax Consultants broke their heads to understand and realize what it is. Fundamentally, a simple system – an understandable system – an easy return, will encourage the tax payer to accept the Policy of the Government. I do not know why the Government disowned the simple returns which we planned long back – I am also one of the participants in the tax return designs. That was considered to be most appropriate and simple, and now why the Government did changed the simplest form to this complicated return, perhaps they too may not know. All the same, a simple tax return system will encourage the tax paper to come into the tax structure and a portion of the money remains accounted.
In the direct tax system, instead of complicated slabs, there should be only one uniform slab for all salaried irrespective of the salary drawn while the existing savings pattern continue. This will help the Government to improve the total savings of the salaried by giving the salaried enough retirement protection.
The next major issue is “Billing”. Billing is not done in many establishments thus the transactions are not routing through the accounting system, thereby giving scope for tax evasion. I suggest the Government to amend the laws in such a manner that all transactions beyond, say, Rs.1000/ or so must be through credit card or cheque. These days almost everyone is possessing “PAN CARD” for some reason or the other, as it became a must for certain transactions. Likewise, usage of Credit Card has also increased and this will be an excellent tool in the hands of the Government.
The basic principles to curb black money are 1) making people to accept the Tax System through simple return and simplification of the procedure, 2) making the transactions routed through proper accounting system, 3) elimination of Cash based transactions, 4) creating an unavoidable situation so that everyone has to remain in the structural formation of the system.
When we accept “credit card payment” for transactions beyond Rs.1000/, naturally money starts entering into the cycle. The second advantage of this is elimination of hard cash which alone is the route cause for “hoarding or Black Money or Unaccounted money”.
An unavoidable situation is such, today, for any transaction beyond Rs.50000/, presentation of a Pan Card has become a must in any bank. Thus people have come to the “Pan Card” circle; interestingly we can find long queues in the counters where “Pan Card” applications are accepted.
In the similar fashion, any bank should take address proof through the Ration Card or Voters Card, before granting a Credit Card. If either of these is made mandatory for the bank, everyone is naturally monitored to become a voter thus giving scope for the quality of voting over a period of time, and furthermore, through Ration Card system, population census becomes easy, besides monitoring flow of essential goods.
Andhra Pradesh Government has done well in this regard, where every ration card contains the LPG connection number, number of residents, and such other fundamental details needed of a household, and this is further guarded by “Finger Print Bio” system to prevent misuse. This is also interlinked with the issue of passport.
Similar exercises are already done by the Government over the past few years and a base is already available, like voter card etc. Therefore there is no loss of time in implementation of a new procedure, in this regard, and we can safely plan out the future for regulating the transactions through this base system.
Thus Credit Card shall become the tool for payments, directly making the transactions start entering into the accounting cycle. The ceiling should be as low as Rs.1000 so that a majority of the transactions enter into the procedural aspect of the accounting system.
Rome is not built in one day, so also economic reforms in India cannot be done overnight. But certain steps – which are practicable and suits implementation, are needed absolutely.
This is a long term plan but short term strategies are needed with a clear set of mind, and this is only solution that suits India. When a system is habituated, it naturally keeps the doors open for curbing of black money and proper increase of the revenue to the Government.
Let us build up a better and healthy economic atmosphere and that is the only primary and fundamental responsibility we have, in front of us. This mailing system does not permit me to write the modalities more than this, but surely I have good modalities that are conveniently suited. If the basic principle is accepted, perhaps, we can do well in a via media mode, let the likeminded people join together to bring reforms in building a great future for Mother India.

THE NEXT POLITICAL PARTY TO POWER - A STRONG POLICY AND BASE NEEDED IN INDIA
We have comfortably spent sixty years after independence and what has been done, whether it is sufficient, whether it is of quality based, whether that alone could be done, whether people are happy with what has been done…..several such? – answers are left to individuals. Congress party ideals and Communist party ideals differ totally and now both the parties are combindly sharing the power. Well, it is not my concern to know about their ideals strength or they desire to get themselves diluted.
My interest is purely concerned with the progress of MY COUNTRY and my fellow countrymen leading their life peacefully, purposefully, eventfully and I look at the overall growth regaining the past glory.
The general elections are not too far. This is absolutely a strategic time to gain confidence of people for any party, eventually the wind is in the side of Congress Party – being in political power right now, provided it is in a position to deliver the goods from a common man angle. The strategic wave length of a beaurocrat or an adhoc policy of a political combination is not – surely not- going to be a long lasting power point for any one. The forthcoming elections are a question of survival for many political parties.
Certain public needs are to be managed and public cannot be convinced for the overnight assurances in front of elections any more, as was done in the past. Therefore if any party is interested to come with an election agenda or manifesto giving assurances to the public what they are going to do if elected for power, shall become a second rated assurance, particularly this time.
A strong political base is a must in the forthcoming elections if India desires to facelift and show the world its quality manpower resources, economic progress and all round development to retain its position on par with any developed nation. To build up a strong political base, ASSURANCES no longer can help, the approach should be practical, result oriented and goods are sure to be delivered. I can show the Government the ways and means to strengthen their base and do something in practical terms to the Public of the Nation. It is surely a lengthy document and this mailing system will not help me to pen down all that.
I know that 2009-14 term of the Nation is quite crucial one and there are chances – abundant chances, to cover up the sixty years gap and focus ahead with a future plan. This would once for all strengthen the base of any political party in India.
People expectations have increased and now they are both quality based and performance oriented. Some patriotic touch is also a must irrespective of individual gains, personal images, and cheap tricks.
I am a small man from general middle class public and having stayed with utmost rural poor for quite a length of time beyond anybody’s imagination in an un-electrified village, I know their needs and I know what they are looking for. Let us not ignore the poor a d less fortunate, let us build up a healthy POLITICAL STRONG BASE FOR THE COUNTRY IN THE FORTHCOMING ELECTIONS.

THE REFORMS I EXPECT INDIA – POLITICALLY RELIGIOUS INTERFERENCE
It is really an unfortunate situation in India that when once a person is elected to Political power, he or she considers himself or herself as the supreme and therefore they can enforce their personal interests on the entire population of the country and lead the public to the “mean” goals set for themselves during their tenure in the office. They forget that India is a secular country and people of different religions are the proud children of the country.
In the recent past, as per the news paper reports, wife of a Political leader and head of a state started campaigning for a Religion along with other family members. She has conveniently forgotten that she is the wife of a leader of the state heading a secular state. This is a very bad situation and it is unfortunate we have such inferior cadre of leaders amongst us who utterly disrespect the spirit of secularism and pave a way to a religious fight. They have also forgotten the oath they had, while assuming the office.
We are fortunate, the former Presidents of the country did not make a way for conversion into Islam, nor did they involve themselves in any way to propagate Islam. We must salute their commitment to the Oath in this regard.
If religion starts ruling the country, it might have lead to many communal riots. Nothing matters to respect his own or her own religion and it is surely a private affair where none can interfere. But when it comes to the position, there should not be such disastrous statements, undesirable religious campaign, unwanted creation of a confusion and thereupon conversion to other religions. Every one elected to a Power or heading the state or the Centre must refrain from such practices.
Religion is an individual choice and it depends on individual liking or otherwise. A Statement from the Political head or his family members is nothing but mis-utilisation of political power.
We cannot go back to the past and say that India should remain as a Hindu State only. Whether we like or otherwise, wars took place, other religions entered into the country and at this stage we have no option than to co-exist creating a friendly atmosphere. We cannot afford sacrificing lives for a communal war. We elect people to upkeep this tendency and not for a butchery.
It is time all of us collectively look at choosing political leaders who does not go for “mean” matters and resort to cheap tactics to win the hearts of a person of their choice, involving themselves in religious propaganda while in office, heading a Government. I fear, nothing could possibly be done at this awful stage to modify the constitution or change the Laws in this direction, but a day should be there where people of the country choose a “quality” based and I am sure we have at least a few amongst us who can deliver the goods x

THE REFORMS I EXPECT IN INDIA – THE NEXT GENERATION (WITH PARTICULAR REFERENCE TO THE JUDICIAL SYSTEM)

Most of you have already been in receipt of series of mails under the caption “The Reforms I Expect in India – The Next Generation”. I did mention few important changes to be brought into the Judicial System to create a confidence amongst the people of India on the Existence of Law and timely justice and also quality justice becomes possible on the holy land. It is to be remembered that once upon a time, Judiciary was considered supreme even the kings were punished severely by the Judiciary.

It is a fact agreed by the learned scholars of Law that “Justice Delayed is Justice Denied” which does mean that timely justice is a must. The second point agreed upon is “though a criminal is let free, surely an innocent should not be punished”. The innocent gets punished in two ways, 1) by the lapse of time and 2) by biased Judgment. These points are exactly the base of this paper whereupon reforms expected are placed for a discussion and an outcome. My knowledge in legal matters may not be sufficient to appropriately suggest the changes wanted, but my logical reasoning expects the following and this is to be further modified and analyzed by the masters in the related field.

I really do not know why and how the Jury system was dismissed in Indian Judicial System when the law mostly was copied from the foreign codes. As earlier suggested a time frame work for civil cases help the people to build up confidence on the system, while a re-introduction of the jury system may help largely in criminal cases. Again, honestly to speak, letting out criminal is nothing but doing injustice to an innocent. Criminals should not feel that they can take shelter under law through the weak links of law in the prevailing situation. I feel that a Jury panel to be maintained by each court which entertain criminal cases, and that the members of the jury should be drawn from the public other than the empanelled advocates. A case also may be considered where 20% of the Jury are from the legal side and the rest from the senior citizens and senior citizens alone who are supposed to have maturity at thought. A large panel to be maintained and a list of jury for each case to be drawn through a machine (human element to pick up the members of jury to be avoided as far as possible which gives room for dilution of the system in the existing conditions). Perhaps law has to be amended in such a manner that proper reforms are introduced at least from now on.

It is really matter of appreciation that the Judiciary now-a-days is firm in its decisions like holding the Government responsible for the attacks on Indians in Australia; publicly coming out by some judges of Madras Court without fear or favor, on the Ministers for influencing the Justice; holding the Government responsible for the irresponsible attitudes of the Registrars in AP and many such. Only Judicial system cannot clean the entire dirt and it is time WE all join and through thought provoking ideas whereupon with a hope that some one – in the system would hear to the cries and takes care of the system.

We have committed people as is seen in the administration of the poll conduct in the recent elections by the Election Commission as well by the Police Administration. We have many quality based people and quality supporters and let us try to upkeep the quality and help at least the next generation to have a safe and purposeful life on the Holy Land of India.

Chapter -QUICK JUSTICE
In the good olden days, the emperors used to hear the pleas of public on specific days and used to decide the cases then and there itself. There were instances in India where the Kings were also punished by the Judiciary. The Judiciary was considered as utmost supreme. The history speaks of the instances where Judiciary was given appropriate placement in order to do justice to the public wherever and whenever needed. This approach created confidence amongst public when Judiciary was considered as immediate grievance redress machinery.
There are three systems of administration in a democratic set up like India, the first one being the Governing body, the second one being the electoral body, and the last one being the Judiciary. I have very little to say about the first two since any news paper does speak of them every day in every forum. Perhaps they have come to a conclusion that the present functionaries in the Governing body and the Electoral body are beyond repairable condition. They are inter- dependant and nothing much can be done in these two areas. The only surviving hope for the country and the countryman is JUDICIARY.
In the absence of immediate grievance redress machinery, people tend to approach rowdies, goondaas, extremists, and other agencies which were preexisted to civilization. A so called civilized society has certain coded order of life and therefore it is called Civilization.
In countries like USA, cases are settled within a time frame work and the punishments are mostly extreme while most of them involve heavy financial penalties. Thus this gives a signal to the public to be cautious since people are not prepared for financial loses. The second kind of punishment, basing on the gravity of crime, is ordering a law breaker to clean the roads, or do something useful to the public openly so that this kind of punishment is not only useful to the public, but also remains as a caution, and also shall remain as a reformation step in the attitude of the law breaker.
The appeal and further appeal, adjournment of the cases infinitely without a time limit are all causing loss of faith in the system and therefore the undesirable anti social elements are cropping up with lot of confidence that the Judiciary cannot do anything, and even if the judiciary does something nothing to worry since the case can be dragged forever and forever on different reasons, at different levels. In other words, there is no reason and scope for fear of punishment and this confidence in the minds of people is making them criminals or scope for committing crimes or for law breaking and the list is endless.
A judiciary can enter into nook and corner when an administration and the electoral cannot. A judiciary can also set right the administration and the electoral and it is the only and THE ONLY HOPE FOR THE COUNTRY today.
It is quite essential that a time frame work, say three months for a civil case including the period of appeal; say six months for a criminal case etc. are a must and this initial step is sure to do lot of wonders in the country. Nothing to worry much about the pending cases, the cases can be handed over to the senior advocates or retired judges who can volunteer to clean up the pending work on war footing basis. From now on, all cases can be kept open on records including the date of filing, the procedural aspects and the status of the case and a kind of transparency shall help people to know what is going on and where exactly the case stands. The system can be linked to internet too. This will help creation of confidence on the system and this will also help to some extent establishment of purity of minds. Some important cases can also be telecasted so that public can see and keep themselves confident of the available redress machinery.
The Law books says that JUSTICE DELAYED IS JUSTICE DENIED. It is up to each of us to decide whether we are denied of justice or otherwise, but let us make sure of ourselves with a certain amount of commitment that we should not DENY justice for whatever reason it is.
It is obviously difficult to change the act since political interference remains as a must for it, but from legal administration angle, of course, I believe there would be great scope for such reforms provided we are committed for it.
Probably some of our children, grand children, great grand children may become the sufferers if we do not plant a seed of discipline today and it is possible only through Judiciary and Judiciary is the only surviving hope for all of us.
Any suffering is possible, for example, the houses which we are giving to children may turn out to be a liability when they fight cases years and years together for getting the house vacated by the tenant, or a criminal is given all comforts in a jail for years and years together when some of our children and grand children remains to be a sufferer all through their life and so on, the list remains again infinite. Is it not time for us to do something?

The Reforms I Expect in India – Banking Reforms
When I thought of writing on “Banking Reforms” I only thought of the apex bank – the controlling bank, Reserve Bank of India. It is not only a controlling bank, but also a friend, philosopher and guide to the Nation and also to the Banking Industry. As a parent organization, the failures in the banking industry are to be necessarily to be owned by it.
In the recent past several banks in the cooperative sectors failed utterly and the depositors are virtually standing on the roads – for the simplest mistake they did – they trusted the Deposit Insurance and Credit Guarantee Corporation which is at the nose of RBI and which assures payment of a lakh of rupees in the event of any bank failure. I really wonder as to why the RBI could not realize and understand that a depositor is the back bone of any bank. Safeguarding their interest is of utmost primary importance for the survival of any bank. Unfortunately creditors are well protected than the depositors.
The depositors provide the financial strength to any bank to lend and make profits. I do not understand why DICGC or RBI fail to arrange for payment of a lakh of rupees maximum guaranteed amount to the deposits when once any bank fails. What is the fun of the depositors going round the creditors with whom they have no absolute concern. This really happened in many cases. Time to time monitoring of the credit portfolio of any bank, conducting audits, making enquiries, obtaining public opinion and all such are the duties of RBI.
Only when RBI fails in its duties, banks in any sector fail. RBI has also the watch dog business in the Banking sector. How and why poor, innocent depositors are dragged onto the roads for the gross negligence of RBI, is a matter worth discussing now. Why at all the RBI displays in every bank a notice to the effect that every deposit is guaranteed to the extent of a lakh of rupees when it does not honor its guarantee? How many such settlements were made when banks failed? Why RBI – the controlling machinery could not smell the failure or mismanagement of a bank well in advance? Any answer from RBI – perhaps NO.
Many small depositors gave up their lives and many girls could not be married due to non availability of funds on time; many small young children could not further their studies due to blocking up of saved funds of small depositors. These are all facts and RBI is aware of this. These mistakes are to be owned by RBI
If RBI is not in a position to upkeep its guarantee for refunding of the depositors money as promised, what fun it is to write a promise on a currency note which has basically no value in these circumstances.
Another interesting child of RBI is Banking Ombudsman. I have seen banks not at all responding to the letters, notices of Banking Ombudsman. It is a puppet creation, perhaps, an eyewash organization created by RBI. I do not know what powers this particular set up has, to take any action against any bank. It is a feather of the same bird and nothing much can be expected of it.
Today we have another problem – a totally different problem and the most important point now is, many foreign banks have entered the banking sector of India and are competing with the banks of Indian origin. The competition is in such a cut throat way, RBI has become a silent spectator.
I really wonder as to how a bank can take a decision for granting of lakhs and lakhs of rupees loan in a few seconds and why are they permitted to allure public in such a fashion and why at all did RBI is watching all this and taking it for granted. Does RBI not aware that it is public money and any bank cannot play with public money in such a fashion?. A decent publicity that any loan does take a few days time for processing and finalization is most welcome than giving a publicity as if the doors are open for the public to carry public money just like that. Is it not the duty of RBI to resist such alluring ads?
At least now, it is time for RBI to reassure public that the deposits are guaranteed up to a lakh of rupees and in the event of any bank’s failure, the amount up to the assured sum would be refunded within a specific period of time, say, three months from the day of failure of the bank.
The second point is resisting all banks to go for undesirable publicity in such a manner that the depositors feel that their saving or investment is casually spent by the banks. In the absence of a proper assurance, people prefer other sectors other than investment in banks which would lead to many other problems to the Nation.
In the recent past, after the failure of RBI to repay the deposit the amount as per guarantee terms, people preferred to invest their surplus in the unorganized/speculative/unhealthy money market – like local chit fund companies etc. many of which have over a period of time turned their boards. The money in the non banking sector is resulting into inflationary trend. Some investments have gone to stock markets, some to Gold market, and some to real estate business, thus we find an upward trend in all these sectors within the past few years – in addition to global market changes.
A deposit in a bank is helping the priority sectors/ neglected sectors in the society, as per the action plan envisaged and this helps the sectoral deployment of credit to support overall plan of a country. Whereas the flow of money into speculative markets, gold markets etc is, in no way helpful to any neglected sectors where support is essential. The other danger in diversion of funds from banking sector to the other sectors is that it amounts to growth of black money, as people do not prefer to declare their profits and legitimately pay the taxes on it. The undisclosed or hidden purchasing power in the hands of public is the main cause for the inflationary trend in the Country. This has created a big gap between rich and poor, for, rich becoming richer and the poor becoming poorest. A danger is ahead of us where a revolutionary check makes us all victims.
Therefore, it is necessary for the RBI to retain public confidence on its policies.
The banking ombudsman’s powers also should be increased to such a level that his position should be delinked from RBI. No officer of any Bank should be given this position as they get influenced to take any decision. A third party – totally independent from the influence of RBI, preferably a retired bank officer – a senior officer, be appointed as a Banking Ombudsman and sufficient powers be given to him to decide the cases. He should have powers to summon even any Bank Chief Executive if needed. Sufficient overall controlling powers alone can make the position of a banking ombudsman respectful and useful to the public.
All cases referred to Banking Ombudsman should also be settled within a time framework of say, three months. This time restriction will help the public that a timely justice is very much assured and anticipated.
This is also a fact that some of the banks – particularly the banks of recent origin, have adopted unfair practices of sending goondaas etc. for recovery of the dues. This speaks that the banks have no faith in judicial system or other remedial methods. They only believe this uncivilized, aged old, practice of unethical banking just to upkeep their recovery. Is it not a shameful act?. It shows the poor administrative capacities of RBI. Why can’t a law be made on par with Revenue Recovery Act granting powers to any bank to recover their monies in times of difficulty? This would have been more a fair deal than observing silence to the unethical acts of the banks.
The growth which is seen in the banking sector is nothing but a paradoxical error for the reason whether banks try for increase of deposits or not, the interest earned/accrued on the deposits is accounted every half year as a deposit only thereby giving a boost to the deposits. Though there is growth in real cash deposits, it is surely not according to the investment capacities of public as the money is flowing out to other markets. This is evidently seen due to flatness of the rates compared to last three years.
It is quite difficult for RBI to administer all this in a vast country like India with multi-dimensional problems, but at least something should be done as per the expectations of the public and to retain its image. If RBI’s image is lost, Rupee image is also lost and then what?................................Dr P V Sesha Sai Aswamedhayaaji
